    UPDATE:  HR 2759 – Mental Health Access Improvement Act

    Adding LMFTs as Medicare Providers

    Thank you for encouraging your U.S. Representative to co-sponsor this bill which would allow LMFTs to become Medicare mental health providers.  Over 1,400 CAMFT members have taken action since this campaign began on July 20, 2015, and as of September 20, seven (7) U.S. Representatives have signed on as co-sponsors to this legislation. 

    U.S. Representatives from California who have signed on as co-sponsors, as of September 20, 2015, include:  Representatives Anna Eshoo, Jared Huffman, Zoe Lofgren, Adam Schiff, and Mike Thompson.  To see a complete list of co-sponsors, click here.

    We have extended this campaign until November 20, 2015 in order to increase the number of co-sponsors and to demonstrate that this bill has strong support. 

    We’ll keep you posted on the progress of this bill.  In the meantime, we ask that you encourage your colleagues to urge their U.S. Representative to co-sponsor HR 2759

    We regret to inform you that the Inland Empire Chapter of CAMFT has been notified that the Board of Behavioral Sciences will not renew approval for our Chapter as a CEU provider for the period of February – June, 2015.  Despite multiple requests on behalf of participants to honor these well-respected trainings, BBS has cited the end of their authority effective July 1st as the basis for the denial. 

    We greatly apologize for the time, cost, and inconvenience this undoubtedly will cause our members and seminar participants and want you to know that we will continue to pursue any option that may rectify this conclusion.  Our understanding from BBS is that they know that you signed license renewals or other actions in good faith and they do not intend audits or actions solely on that basis.  For a more complete explanation regarding this outcome, please see  CEU FAQs[3].pdf

    Though this denial represents a substantial financial loss for our chapter, we accept responsibility to compensate for the unforeseen burden it places on our seminar attendees.  IE-CAMFT will send refund checks to everyone who attended any of the seminars from February to June 2015 who wishes to be reimbursed.  Please notify me if you wish reimbursement at this time for any or all of the seminars you attended.  We will get a check out to you right away.

    The CAMFT Board voted on May 27, 2015 to propose a recall vote by the clinical membership of newly-elected president Laura Strom in what appeared to be an attempt to derail the SAVE CAMFT movement and vote of last year.  The stated reason was that “Strom has engaged in an ongoing pattern of conduct detrimental to CAMFT which violates her duties as an Officer of the CAMFT Board of Directors.”

    The SAVE CAMFT slate of candidates had run on a campaign of bringing more transparency and democratic process to the Board's actions following a controversial move on the part of the previous board to turn our organization into a generic mental health organization rather than a specific trade organization for MFT's.  The attempt to call for a vote to recall Laura Strom, who had been voted in along with the other SAVE CAMFT candidates by a landslide, was quickly reversed by a subsequent vote rescinding the proposed recall vote.  Below you will find statements by the Board CFO, the previous Executive Director, the Redwood Empire Chapter, and a link to Laura's refutation of the accusations lodged against her by the CAMFT Board.  More information can be obtained from the CAMFT.org website.

    Statement by Jurgen Braungardt, CFO:

    Hello Everyone,

    I owe it to the members that I explain my vote on the Board in such a grave action against the incoming President. I was the only dissenting voice, so the following points obviously reflect only my own perspective, and are not shared by the rest of the Board.

    In my opinion, the recall is a political move that reflects the backlash against SaveCAMFT. Laura has done nothing that deserves a recall. She is a scapegoat for the SaveCAMFT movement.

    The Board has successfully cornered itself with this move: If the Board fully explains to the members why they did this, it would have to explain what happened in dozens of hours of closed session meetings, and what actions were taken - again! - in secrecy. Obviously, the CAMFT Board did not learn enough lessons from the bylaws fiasco. It they don't disclose the background information, they ask the members to validate a flawed decision that tarnishes Laura's reputation and shows disregard for the membership. Without sufficient information, the members should vote to refute this recommendation.

    Members should continue to demand more information about what has happened behind closed doors at CAMFT. One of our core values is transparency. The often-repeated principle for many of the Board's actions is a duty to uphold confidentiality, which gets used to hide many actions and documents that in my opinion the members are entitled to know.  This is a member-driven non-profit organization, not a company with many trade secrets to protect. We, as members, should shine a light on the way CAMFT operates! The members have the power to hold the leadership accountable, and to change it if necessary. For instance, the members can call for a special meeting and make powerful decisions such as recalling individual board members, or even the entire Board.

    The reasons they cite as to why the members should recall Laura are not sufficient grounds for removing a board member. Additionally, only six members voted in favor of it, which is not even a majority of the whole Board. Furthermore, in the official E-blast signed by Jodi Baldel and Leah Flagg-Wilson, they justify the recall motion by citing a bylaw paragraph that does not exist. So technically, the recall-announcement is not valid.

    The members who supported the Save CAMFT movement should ask each and every one of their representatives how they voted on this issue, and why.

    The Save CAMFT movement was a historic event in the history of CAMFT. It was created as a response to a crisis - the theft of our MFT trade association. The Board, with full participation of the ED, tried to change the nature of CAMFT, and create a generic masters-level mental health organization without notifying the members. The members overwhelmingly rejected this change. However, in the past year serious problems still exist within the organization. In order to change this, we need full transparency and accountability. The Save CAMFT movement needs to continue, because these goals have not been achieved. Vote to defeat this attempt to recall Laura and to silence the SaveCAMFT movement!

    To: Save CAMFT Participants and Others

    From: Mary Riemersma, Prior CAMFT Executive Director 1985 to May 1, 2011:

    I have read the email blast that CAMFT sent about the member vote to be taken on Laura Strom. I have been remotely aware of some of the Board's assertions against Laura since she was elected by the members. I am also aware of some of the Board’s decisions on other matters over the last four years. It is frankly shocking, appalling, and embarrassing. Even more shocking, appalling, and embarrassing is that while CAMFT has and will share any propaganda that the Board and staff desire, Laura Strom is given NO opportunity for rebuttal unless she personally pays for a separate email blast.

    The reasons that are being given to encourage members to vote for her removal appear flimsy at best and generally without merit. This effort does resemble a witch-hunt and appears, to an outsider, to be Board Members digging deep to unearth excuses to unseat her. While these reasons for removal could be scrutinized at great length, I will try to be brief.

    My thoughts about the reasons given to assert that she has allegedly engaged in conduct detrimental to the best interests of CAMFT and violated her duties as an officer of the CAMFT Board of Directors follow:

    1. There are no issues with a Board Member speaking with an applicant for the Board and encouraging or discouraging him/her about pursuing the election. Such action may be considered responsible and not detrimental to CAMFT.

    2. Asking a fellow Board Member for a favor, whether accepted or rejected, has no effect on CAMFT. This allegation is frankly laughable and I encourage members to read it carefully.

    3. Making an imperfectly stated post to a listserve intended for a small number of CAMFT members, especially when it is swiftly clarified and corrected, should not be deemed as detrimental to the best interests of C MFT.

    4. The supposed confidential = information that Laura Strom allegedly distributed to a few CAMFT members was not marked confidential and in fact should not have been considered confidential information. In actuality, it appears the real intent here is to squelch the dissemination of information that would demonstrate THE BOARD was not operating in CAMFT's best interests.

    5. Board Members are permitted to be critical and may share concerns about staffing and management practices, especially when they believe there are major deficiencies that need to be corrected.

    As a final note, the Board, by taking this action, apparently failed to consider how detrimental this process would be to CAMFT and the members it represents. Given that there are already serious trust issues between members, Board, and staff, this effort appears to widen that chasm rather than rebuild and reinforce the tarnished relationship that has grown over the past few years.

    On June 6, 2015, the Board approved the following proposed language for a Policy Restricting Advertising Sexual Orientation Change Efforts (SOCE) or Reparative Therapy in CAMFT Publications:

    “CAMFT does not accept print, electronic, or any other form of advertising, that is intended for publication by CAMFT, or inclusion in any CAMFT medium, which offers or promotes sexual orientation change efforts, reparative therapy, and/or conversion therapy.”

    The Board is seeking member feedback to this proposed policy language through Tuesday, June 30, 2015.

    As your newly-elected board, we have decided that we should withhold our approval of the recently-revised CAMFT Chapter Agreement until CAMFT responds to some vital suggestions proffered by the Santa Clara Valley Chapter addressing issues such as bylaw review, suspension or termination, and the inspection of records.  We believe we should not be rushed into any agreement that may not serve our needs, may impose onerous requirements, or may still be too one-sided and wanted to make you aware of our decision to further negotiate the terms of the agreement.  For more information or to comment on the agreement, go to the Forum 1 page on the website under the "Members Only" section.

    CAMFT is pleased to announce its new Continuing Education Provider Approval (CEPA) program. CAMFT recognizes its responsibility to assist members of CAMFT and other BBS-licensed professionals with identifying and participating in quality continuing education (CE) as a means to ensure practice competence and professional growth.

    The Board of Behavioral Sciences approved CAMFT as an approval agency on November 20, 2014. As a CEPA Agency, CAMFT has the authority to approve CE providers for Licensed Marriage and Family Therapists, Clinical Social Workers, Professional Clinical Counselors, and Educational Psychologists. Providers seeking approval with CAMFT can submit an application for consideration after January 1, 2015 and CAMFT-approved providers can begin offering CE as of July 1, 2015.

    Proposed Dues Increase: Furthering Progress and Managing Increasing Business Costs

    At the March, 2014 Board Meeting, the CAMFT Board of Directors voted to recommend a dues increase to the general membership. The Board directed staff to provide members with an explanation of the need for a dues increase and solicit member comment for discussion at the September, 2014 Board of Directors meeting.

    CAMFT is an association that revolves around two primary themes: 1) the advancement of marriage and family therapy as an art, a science and a mental health profession, and 2) the advancement of the common business interests of its members.  

    The increased costs of maintaining CAMFT’s strong infrastructure, member benefits, and programs call for additional dues income. Despite very frugal management of finances, CAMFT’s operating costs increase by approximately three percent annually without a corresponding increase in revenue. An increase in membership dues is necessary to keep pace with inflation, sustain progress, and facilitate new projects to further advance the professional interests of members.

    CAMFT has not raised dues in four years for clinical members, and three years for associate and prelicensed members. The Board will consider a modest annual escalation of dues planned over a five-year period. (Please see the chart below for the proposed dollar amounts.)

    As a result of the last dues increase, the following services and benefits were implemented to increase the value to your membership:

    • Additional staff to answer members’ questions regarding business, legal and ethical issuesundefinedthe number of questions CAMFT’s legal department handles increases annually. On average, the legal team receives approximately 25,000 calls per year. CAMFT has been able to add two legal staff members to accommodate the increased call volume and to continue to provide the same quality service with minimal wait times for members.

    • $5 Rebate for Renewing Early Online – this feature was added in 2012 and has provided members over $56,000 in rebates to date. The online renewal offers members convenience and removes administrative burden from staff to handle other member issues.

    • Free professional liability insurance for graduate student membersundefinedto support the journey to licensure, CAMFT partnered with CPH and Associates to provide this member benefit at no cost to prelicensed student members.

    • Enhanced Professional Development Opportunitiesundefinednew opportunities include an on-demand learning system that offers online opportunities to fulfill CE requirements, and increased offerings of targeted live and online events on hot topics such as CPT Codes, DSM-5, supervision, and law and ethics.

    • EBSCOhost Psychology and Behavioral Sciences Collection™undefineda powerful online research service that provides access to full-text articles from nearly 600 journals. The Collection allows members to search for peer-reviewed information pertaining to professional interests, whether clinically-driven, personally-motivated, or research-oriented.

    • The Legislative Action Center undefinedan online advocacy program that provides members with up-to-date information on relevant pieces of legislation and provides the tools members need to become active in the legislative process. This program allows CAMFT to send email alerts and advocacy messages to members and key legislators at the state and national level.

    If adopted by a three-quarters vote of the Board (pursuant to CAMFT Bylaws, Article VIII, Section B), CAMFT member dues will increase on January 1, 2015, and thereafter, as noted in the chart below.

    Board Meeting Highlights

    The following notes highlight discussion and action from the June 7-8, 2014, CAMFT Board of Directors meeting in San Diego.

    (Note: On Friday evening, June 6, the CAMFT Board met informally with leaders from the San Diego North Chapter and San Diego Chapter. These “Board-to-Board” gatherings are intended to allow for interaction between state and local leaders when the CAMFT Board is meeting in a chapter’s area. The Board also presented State Senator Wyland with the “2013 Legislator of the Year” Award at that reception.)




    Board Orientation

    Outside Counsel presented a Board orientation that reviewed the best practices and legal standards and liabilities of nonprofit trade association Board members.

    An association expert in Robert’s Rules presented an overview of parliamentary authority and “Small Board Procedures” to assist the Board in governing strategically.




    Policies and Procedures

    The Board reviewed and signed Conflict of Interest and Anti-Trust Compliance Policies. Such actions occur at the start of each new Board year.

    The Board reviewed the existing CAMFT statement on Sexual Orientation Change Efforts (SOCE). The Board directed staff to develop additional language for the statement that includes the California legislature’s intent in passing SB 1772 and reflects CAMFT’s support for the intent and spirit of that bill. The Board will review the proposed language at the September Board meeting.

    The Nominating and Election Procedures that were approved in June, 2013 and amended in December, 2013, were rescinded. The bylaws that were re-instated in December, 2013, include nominating and election procedures that will control future elections.

    The Board adopted an “Election-Day Ballot Counting Policy” to codify procedures for collecting ballots, verifying membership of the voter, and counting the ballots.

    The Board adopted a “Policy on Advertising” that includes language that CAMFT will sell advertising space to any advertiser when the content of the advertising does not interfere or directly conflict with the mission, policies, statements, objectives or interests of CAMFT.

    The Board modified the December, 2013 “Policy on Chapters” to include the long-standing requirements for the formation of a chapter. The intent is to bring all of CAMFT chapter-related policies into one document.

    The Board discussed the bylaw provision that makes a member ineligible for election if his/her election would result in the Board consisting of more than two persons who are licensed as a marriage and family therapist and who also hold any other license(s) which permits the practice of health care, whether mental or physical. The Board clarified the meaning of “licensed” as inactive, retired, delinquent or active. Those Board members who could be considered dually-licensed recused themselves from that vote. The Board agreed that the bylaw language of “health care, whether mental or physical” pertains to anyone with a license in a field that covers mental health or physical health. Therefore, the bylaws will be interpreted to preclude anyone with an active, inactive, retired or delinquent license that permits mental or physical health care from serving on the Board if two members are already serving on the Board who are licensed as MFTs and hold any other license which permits the practice of mental or physical health. (Note: There are two members of the 2014-2015 Board who are dually licensed, as defined, and who will be continuing their Board term in 2015-2016. Thus, no CAMFT member who is dually licensed, as defined, shall be eligible to run for the Board in 2015-2016.) The Board agreed to begin the conversation with the membership to discuss the purpose and rationale of the current bylaw provision that makes other dually-licensed members ineligible for election if two dually-licensed members are already serving. (Note: The restriction does not apply if a Board member, during his/her term, becomes licensed in another discipline that allows the practice of mental or physical health.)

    After reviewing best practices of other organizations and discussing concerns about liability, the Board declined to pursue further research on webcasting Board meetings. However, the Board did agree that a public version of the Board meeting materials (which would not include confidential or other sensitive information) should be posted in the members-only section for members to access prior to the Board meeting.




    Committee Reports and Nominations

    The Purview Committee held its inaugural meeting and reviewed the Purview Policy and the need for member input on issues presented to the Committee. The Committee also determined that a more thorough submission process should be implemented to assist them with applying the policy. Members will soon receive a survey for input on whether CAMFT should be working on/devoting resources to the issue of “single payer health care.”

    The Crisis Response Education and Resource Committee is focusing on establishing a robust Crisis Response section of the CAMFT website by September, which is National Preparedness Month.

    The PAC Committee will be sending out a fundraising letter this summer that will focus on the history and success of the CAMFT PACs.  

    The Ethics Committee reviewed complaints and monitored probations. All records and minutes of the Ethics Committee are confidential.

    The Elections Committee provided input into the “Election Day Ballot Counting Policy” and recommended that the Bylaws Committee consider changes to the bylaws to allow for electronic voting.

    The Continuing Education Provider Approval Program Task Force assisted staff with creating an initial provider approval application, renewal applications, and program supporting documents. The BBS just announced a delay in the regulations that would allow them to delegate the authority to approve CE providers to “approval agencies.” Thus, the BBS will likely not have jurisdiction to review the CAMFT application to become an approval agency until the November BBS Board meeting.

    The Board discussed a proposal for a Public Outreach Committee to help create the public messaging to promote the benefits of mental health therapy, to promote LMFTs, and to brainstorm about new advertising vehicles and strategies. The Board created a Board Task Force to develop a mission and composition suggestions for this new Committee.

    The 2014-2015 Committee appointments were approved. It was noted that there was an overwhelming interest by members to volunteer, resulting in many more applications than vacancies to fill. The President considered backgrounds, skill sets, experience with CAMFT, and the fit with other Committee members when selecting appointments. Members are encouraged to apply or re-apply for 2015-2016 Committee positions.




    Proposed Partnerships

    A guaranteed-health insurance option through RL Wells & Associates continues to be available for CAMFT members in the Sacramento, Solano, Marin, Napa, and Sonoma counties and the next open enrollment is in November. CAMFT continues to seek guaranteed-health insurance options in other parts of the state so all members can participate.

    The Board considered an affinity proposal from AmeriDoc, a provider of on-demand health care access services (i.e. tele-medicine). The Board took no action on pursuing the partnership, but suggested that the vendor advertise in The Therapist.




    Member/Chapter Issues

    The draft Chapter Affiliation Agreements were distributed to Chapter Presidents, Presidents-Elect, and Vice Presidents for comment through August 25, 2014. Staff will also post this information on the Chapter Leadership Listserv and contact each Chapter President to confirm receipt of the material and invite comment. The Board will review all suggestions at the September Board meeting.




    Proposed Project

    The Board reviewed a proposed member project that requested CAMFT encourage the BBS to utilize information provided by Track Your Hours (a private, fee-based software that applies the relevant state requirements to trainee/intern hours and populates weekly logs and Experience Verification Forms) as a supplement to the BBS verification process in order to expedite the exam evaluation process. The Board reviewed the viability of such a recommendation being implemented by the state, along with the current BBS activity and efforts (both short and long-term) to reduce backlogs in the exam evaluation process. The Board took no action on the proposal. The BBS has indicated the backlog should be returned to the normal 60-90 day processing time by the end of 2014.




    Member Forum

    Dr. Faye Snyder, LMFT, discussed her concern about the BBS backlog in exam evaluations and offered suggestions to alleviate that backlog. Dr. Snyder also noted that she applied for multiple committees and was unhappy that she was not selected to serve. Daren Lawes, LMFT, commented that very few people who applied for Committees were selected.   Maureen Sklar, LMFT, added that she applied for several Committees and was not offered her first Committee of choice.




    Operations

    As of May 13, 2014, nearly 4,300 student-members had taken advantage of CAMFT’s new student-member benefit of complimentary professional liability insurance through CPH and Associates.

    Four “CAMFT Connects” meetings have been scheduled for 2014 and are being promoted on the CAMFT website and via emails and publications.

    CAMFT is interviewing candidates to fill two staff vacancies: Outreach Coordinator and Staff Attorney.  

    The prelicensed quarterly newsletter will resume this summer and staff will be researching options for an online “CAMFT Connects” with prelicensed members for 2015.




    Programs/Outreach

    CAMFT members were featured on two live, in-studio television interviews (San Diego and Sacramento). When LMFTs are featured on television segments, CounselingCalifornia.com experiences a surge in visits.

    A re-design of the CounselingCalifornia.com and CAMFT.org websites are in progress.

    CAMFT’s 50th Annual Conference attracted 644 attendees and included new features such as an “onsite guide,” an Exhibit Hall passport game with prizes, a complimentary lunch (thanks to the sponsors), and fun, free extracurricular activities. A 50th Anniversary party was held at the Annual Conference. The 2015 Annual Conference agenda has been set by the Annual Conference and Continuing Education Committee.

    Advanced DSM-5 workshops will be held in Northern and Southern California and live CAMFT Legal and Ethical workshops are being offered in areas where CAMFT chapters are not utilizing CAMFT’s complimentary workshop offer.

    The 2014 Fall Symposium will be held November 8-9 in Berkeley.

    On-demand Continuing Education videos will be offered by CAMFT shortly. CAMFT will have law and ethics and DSM-5 seminars in the initial launch of this online library.




    Chapter Relations

    The re-instated bylaws shift the structure of the Chapter Boards back to a specific composition. Chapters should take note that their Board shall be comprised of no more than 35% of associate members or prelicensed members and such members shall not serve as President, Past President, or President-Elect. Chapters must request approval by the CAMFT Board if their Board deviates from the CAMFT bylaws.




    Finance

    The reserve fund balance as of May 31, 2014 was $6.1 million.  




    Legislation/Advocacy

    The Board heard updates about the BBS and state/federal legislation.  

    CAMFT-sponsored AB 1775 (Melendez) would include knowingly “downloading, streaming or accessing child pornography through any electronic or digital media…” as a mandatory report in addition to duplicating and printing.   This bill has received no opposition to date and is supported by the Board of Behavioral Sciences, California State Sheriff’s Association, and the California District Attorney Association.

    CAMFT-sponsored SB 578 (Wyland) was a gut and amend of SB 1148 (Yee). This bill would require LMFTs to keep their records for a minimum of 7 years. The BBS supports the need for legislation to clarify the vagueness of this legal issue. Licensed Professional Clinical Counselors, Licensed Educational Psychologists and Clinical Social Workers have asked to be amended into this legislation as well.

    CAMFT-sponsored SB 1012 (Wyland) would allow interns to obtain 6 hours of supervision per week. CAMFT believes the law should be amended to increase the limitation on supervision because many of our members work in multiple settings and require more than the current cap of five hours of supervision in a week in order to meet the direct supervision ratios. The BBS is in support of this bill.
